Given the issues agencies still have with portable alcohol devices, it is highly unlikely the Drug DWI detection machines will be useful, let alone reliable. Recent tests, for example, have yielded positive opioid results after eating poppy seed muffins. Nevertheless, you can expect officers to use them in making DWI Drug arrests and our Drug DWI Lawyers, for lack of a better word, to terminate the machines.[/vc_column_text][/vc_column_inner][/vc_row_inner][vc_row_inner css=”.vc_custom_1557778349308{background-color: #ffffff !important;}”][vc_column_inner][vc_custom_heading text=”Drug DWI Sobriety Exercises”][/vc_column_inner][/vc_row_inner][vc_row_inner][vc_column_inner width=”1/4″][vc_single_image image=”10306″][/vc_column_inner][vc_column_inner width=”3/4″][vc_column_text]A DRE (Drug Recognition Expert) officer is trained to recognize Drug DWIs. The DRE officers use a 12-part examination to determine if a person is impaired due to a specific category of drugs. These exercises are standardized, meaning the officer shall not vary in explaining, demonstrating, performing and analyzing the DRE exercises. Not only, do officers often fail to administer these exercises as they are taught, but the exercises themselves are prime for biased, inaccurate and misleading conclusions. That is, the prosecution must prove beyond a reasonable doubt a person was driving while intoxicated. To do so the State must show 1) a person does not have the normal use of their mental or physical faculties through the introduction of alcohol or drugs (prescription or unlawful) or 2) a blood alcohol concentration of 0.08 or higher at the time of driving. Because there is no “per se” blood alcohol concentration with drugs, like there is alcohol (i.e. 0.08), the State’s case in a Drug DWI rests on a person not having the normal use of their mental or physical faculties. A burden that is difficult to prove, especially given the arresting Drug DWI officer has no reference point for what is normal for the accused charged with a Drug DWI.[/vc_column_text][/vc_column_inner][/vc_row_inner][vc_row_inner css=”.vc_custom_1557779010560{background-color: #ffffff !important;}”][vc_column_inner][vc_column_text]
