Driving While Intoxicated is often referred to as a “political crime”. This is because penalties for DWI have stiffened as organizations pressure legislators to increase the consequences of DWI.

The majority of DWIs are misdemeanors, however there are exceptions. The offenses listed below are considered felony DWIs. Understand these are the punishment ranges and do not take into account the possibility of probation (nor the abilities of your DWI criminal defense lawyer).

Special Issues A child passenger is someone 15 yrs. old or younger. You must have, and the state must be able to prove, 2 prior DWI convictions. The state must prove: you caused the accident + the accident was caused by intoxication + serious bodily injury occurred. The state must prove: you caused the accident + the accident was caused by intoxication + death occurred.
Punishment Issue If there are multiple victims the sentences can be “stacked” (i.e. added together) as opposed to “concurrent” (i.e. run together)
