Example: The accused was charged with murder. He was not satisfied with is criminal attorney and wanted to hire a Texas Board Certified Criminal Law Specialist to represent him at trial. The punishment range for murder in Texas is five years to life and up to a $10,000 fine. At the free consultation I asked him to carefully explain the facts of his case. He explained he had a gun and shot a man who had threatened him earlier in the evening at a night club. My client encountered the man outside the club and was forced to use his gun to defend himself. After hearing the facts I was able to quickly analyze and determine our position. A jury trial took place months later, and the jury found my client Not Guilty. |

Example: In a recent case, my client was accused of sexually assaulting a five year old child. The child was not his daughter, but that of his girlfriend. He was in the process of breaking up with her when she decided to take her daughter to Child Protective Services for a statement. While there was no medical evidence to support the accusation, my client had a criminal history that included probation revocation and possession of drugs. He did not, however, have any history or record of prior sex crimes. Because of his prior criminal history, his punishment was enhanced to twenty-five years to life in prison. After two days of deliberations the jury was hung up 10-2 for acquittal. Shortly thereafter the prosecution dismissed the sexual assault charges.
Example: This case involved an accusation by a three-year-old child who spent the afternoon playing with my client's daughter in his backyard on a water slide. My client put sun screen on his daughter and her friend. The mother of the visiting girl, who we later discovered had serious emotional problems, heard about my client applying sunscreen and overreacted. The mother took the child to Child Protective Services, the child gave a statement, and my client was accused of indecency with a child. In this example my client had no criminal history. The case was set for trial and after jury selection; the prosecution dismissed the indecency sex charge.

Example: Our client was driving home from her friend’s house where she had a couple of drinks. She was roughly two miles away from her house, when she was pulled over by the Houston Police Department. The officer had her perform the standard field sobriety tests on the street and concluded she was intoxicated. Our client was arrested and charged with the criminal offense of driving while intoxicated. Our client refused the breath test and blood test. Ultimately we went to trial and after all the evidence was heard, the jury hung up 5-1 in favor of acquittal. Shortly thereafter the state dismissed the charges.

Example:A young man placed an ad in Craig’s List under the erotic services section in hopes of meeting a female. Eventually he got a response and over a month spoke back and forth with the female before they decided to meet. Unbeknown to our client, the female was actually an undercover officer hoping to arrest our client for criminal prostitution. During a taped conversation it was clear the officer entrapped our client into accepting sex for a fee. After the state would not agree to dismiss the charges, the case went to trial. The jury deliberated for fifteen minutes before returning a verdict of not guilty.

Example: A friend came to me accused of mortgage fraud. Under Texas Criminal Law the punishment for this type of crime is based upon the loss. In this case, the loss amounted to a 1st degree felony, five years to life and up to a $10,000 fine. My friend stated he had sold two houses to a gentlemen, who told him he was getting more money from the lender than the house was worth because he intended to remodel the house and resell it. He wanted my friend to take out his sales price and refund the difference to him for the remodeling. My friend obliged. Five years later the buyer was indicted on a multi-count indictment alleging theft and mortgage fraud of over five million dollars. The two houses my friend sold were included in the case and my friend was indicted as a co-conspirator. After seven months of negotiations the prosecutor agreed to dismiss the charges.
